We understand that Aldea Asesores, SL have filed for ‘creditor protection’ which means an administrator is appointed by the Spanish Courts to run the Company.
The duty of advising all of Aldea Asesores’ clients of the situation falls to the Administrator – they should have communicated by post or email.
The ‘administrador’ has been named as Juan Carlos Dominguez Serrano. If you have not received anything from the administrator and you are a client of Aldea’s in any way please email fiscalisquolex@hotmail.com
You must submit details of any claim you may have against Aldea Asesores within 15 days from the date that the administration notice is published in the Spanish Law Gazette. Unfortunately, the administrator will not advise you of this or the date when the notice is published – as yet we are unable to advise on this date.
If you think you are a creditor of Aldea’s, have a claim against them or they are holding funds on your behalf then you should immediately appoint a lawyer in Spain. If you can only appoint a UK lawyer then they must deal specifically with Spanish law. Your lawyer will explain the steps you need to take, if any, depending on your relationship and situation with Aldea. The lawyer will undertake the necessary procedures for you. You will need to provide the lawyer with details of your relationship with Aldea i.e. whether they are acting for you in an uncompleted purchase, whether they are in possession of monies you have transferred to them or that they have obtained on your behalf and not yet passed over to you, whether they are acting as fiscal advisers, whether they are holding documents for you etc.
Depending on how Aldea Asesores have been acting on your behalf we would suggest that you:
- do not send funds Aldea for your property purchase – instead send them to your personal account in Spain in readiness for your notary appointment
- do not send fees to Aldea, until advised otherwise by the administrator, that Aldea may have requested for fees or fiscal advice
